DE LA AUTONOMÍA PROCESAL EN LAS RESOLUCIONES DEL TRIBUNAL CONSTITUCIONAL PERUANO

SUMMARY   In the present investigation we intend to determine if the Peruvian Constitutional Court when interpreting the principles or constitutional requirements is creating or modifying figures and procedural institutions under the basis of the "principle of procedural autonomy", causing negative effects such as legal uncertainty, transgressing the principle of delegation of powers with the consequent delegitimizing of institutions that manage the justice in the country, and, if necessary, suggest certain limits to this "procedural autonomy".   Effectively we have divided the work in four chapters. The first is referring to the principles of the procedural law and autonomy of the Constitutional Court . In reference to the procedural principles, these are used to explain and sustain the essence of the process in relation to a given procedural system of a country, in a historic moment specific; and must distinguish between the principles of the rules....
